Tuudo End User Terms of Service

General
Tuudo (hereinafter the ‘Service’) is a service administrated and maintained by Tuudo Oy (hereinafter ‘Tuudo’). The Service may also include content and services produced by the Subscriber or any third parties. The Subscriber is the educational institute or other entity that has subscribed to the Service in order to provide it to its defined end users (hereinafter ‘Users’), such as its own students and staff.
By using the Service, the User is deemed to accept and comply with these Terms of Service.

Rights of Use
The User is granted the right to use the Service in accordance with the Agreement between Tuudo and the Subscriber. By using the Service, the User is deemed to accept and comply with these Terms of Service. The User shall understand that any content and services provided by third parties may be subject to separate terms and conditions.
All features of the Service that require a log-in shall be considered private, and are to be used for personal purposes only. Use of these features for any other purpose is forbidden.
The Service content and visual appearance are copyrighted to Tuudo Oy. The copyrights of third party content and services are held by Tuudo Oy or by the third party in question.
Tuudo Ltd’s Liabilities and Obligations
Tuudo is the provider and the maintainer of the Service. The Service may also include content created by Tuudo’s partners, other third parties and the Users themselves, as well as hyperlinks to other services provided by these parties. Tuudo shall not be held responsible for any services or content provided and/or created by these parties.
Tuudo does not guarantee uninterrupted and faultless operation of the Service. However, Tuudo shall endeavour to maintain the Service to the highest standard and as faultless as possible. Tuudo shall retain the right to interrupt the Service for reasons such as, but not limited to, implementation of changes, maintenance, and legal requirements. Tuudo also reserves the right to expand, change or restrict the Service as part of normal development.
Tuudo shall not be held liable for any factual or technical errors or deficiencies within the Service, nor for any direct or indirect losses that may be incurred to the User as a result of using information included in the Service, unless otherwise dictated by law.
None of the information, advice or directions given in the Service is intended as legal and/or commercial information, advice or directions which would in any way be binding on Tuudo or any other third party, and therefore they cannot be invoked. No claims can be issued against Tuudo or a third party based on such information, advice or directions.
End User’s Liabilities and Obligations
The User shall be liable for the acquisition and functioning of any equipment, software and network connections required in order to use the Service, and any costs associated with them.
The User shall be liable for the content and correctness of any information entered by the User within the Service. The User shall refrain from using the Service to handle or send illicit or illegal material. The User shall also be responsible for the safekeeping of the User’s own user credentials.
The User shall be liable for all usage under the User’s own credentials, including any related costs or charges, resulting from the use of the Service. The User shall undertake to use the Service in accordance with these Terms of Service, good practice and effective legislation. If the User is found to have acted in contravention of these Terms of Service, Tuudo shall have the right to revoke the User’s rights to use the service and partially or fully restrict the User’s access to the Service. The User shall be fully liable for any costs and damages incurred to Tuudo or its partners as a result of the User’s contravention of these Terms of Service.
Personal Data
Tuudo shall have the right to process personal data related to the provision of the Service in accordance with effective legislation. More information concerning the handling of personal data is available to the User in Tuudo’s Privacy Policy.
Data Security
The User shall be aware that the web environment and online services are not fully secure. The User shall be responsible for the data security of the User’s own systems and devices.
Tuudo shall provide the Service using generally acceptable and effective data security solutions. Tuudo shall not be held responsible for the data security of any third party services available through the Service.
Term and Termination
These Terms of Service are valid indefinitely. Tuudo shall have the right to modify these Terms of Service. The User shall be aware of any changes to these Terms of Service, and shall accept the changes in order to continue using the Service. The user is deemed to be bound by these Terms of Service whenever using the Service.
Dispute Resolution
Resolution of any dispute based on these Terms of Service, related to the Service referred to in these Terms of Service, terms and conditions specific to a Service, and/or any agreement signed through the Service, shall primarily be sought through negotiations between Tuudo and/or its partners and the User. If this is unsuccessful, the dispute shall be resolved in the District Court of Oulu (‘Oulun käräjäoikeus’ in Finnish), subject to Finnish legislation.
